Terms of Service

These Terms of Service ("Terms") govern your access to and use of nextgenwebpro.com and related tools, including the AI Workforce Audit, AI Workforce Scorecard, and associated forms and booking pages (the "Services"), provided by NextGen Web LLC ("NextGen Web," "we," "us," or "our"). By using the Services, you agree to these Terms.

1. Eligibility

The Services are intended for business owners, operators, and professionals age 18 or older. By using the Services, you represent that you meet this requirement.

2. Description of Services

NextGen Web provides AI automation, software, consulting, marketing, and revenue-systems services, including free assessment tools (such as the AI Workforce Audit) and paid consulting, implementation, and managed services.

3. Free Assessments and Roadmaps

Any score, readiness percentage, savings estimate, or roadmap generated through our assessment tools is an illustrative estimate based on the information you provide. It is not a guarantee, appraisal, audit opinion, or professional recommendation, and should not be relied upon as the sole basis for a business decision.

4. No Guaranteed Results

NextGen Web does not guarantee specific revenue, cost savings, conversion rates, or other business outcomes from use of our Services, consulting engagements, or implementation work. Results vary based on your business, market, execution, and factors outside our control. Any figures presented in marketing materials, case studies, or assessments are illustrative or based on specific past engagements and are not a promise of similar results for you.

5. Paid Services and Payment

Paid engagements are governed by a separate proposal, statement of work, or order confirmation, which will specify scope, deliverables, pricing, and payment terms. Payments may be processed through Stripe, JVZoo, or another third-party payment processor, subject to that processor's own terms.

6. Scope and Change Control

Work performed under a paid engagement is limited to the scope defined in the applicable statement of work. Requests outside that scope may require a separate change order affecting price, timeline, or resources, which we will discuss with you before proceeding.

7. Scheduling and Consultations

Consultations booked through our scheduling provider (OnceHub) are subject to availability. We reserve the right to reschedule or cancel a consultation with reasonable notice.

8. Intellectual Property

All content on the Services, including text, graphics, tools, and assessment logic, is owned by NextGen Web LLC or its licensors and is protected by intellectual property law. You may not copy, reproduce, or create derivative works from our content without permission.

9. Client-Provided Materials

If you engage us for paid services, you retain ownership of materials, data, and access credentials you provide to us, and grant us a limited license to use them solely to perform the engaged services.

10. Confidentiality

We treat non-public business information you share with us as confidential and will not disclose it to third parties except as necessary to perform services, comply with law, or as you authorize.

11. Third-Party Services

Our Services rely on and integrate with third-party platforms, including GoHighLevel, OnceHub, Stripe, JVZoo, and advertising platforms such as Google, Meta, and OpenAI. We are not responsible for the availability, performance, or practices of these third-party platforms.

12. Disclaimer of Warranties

The Services are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

13. Limitation of Liability

To the maximum extent permitted by law, NextGen Web LLC will not be liable for indirect, incidental, special, or consequential damages arising from your use of the Services, and our total liability for any claim will not exceed the amount you paid us in the twelve months preceding the claim.

14. Termination

We may suspend or terminate access to the Services at any time for conduct that violates these Terms or is harmful to other users or our business.

15. Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to conflict of law principles. Any dispute arising from these Terms or the Services will be resolved in the state or federal courts located in New Jersey.
